Reckless Driving may well be one of the more dangerous summonses to receive.
First, reckless driving is a misdemeanor. Therefore, if you are convicted of reckless driving, you are going to have a criminal record.
Second, a reckless driving conviction will result in points on your driver's license, even though the conviction comes from a pink summons instead of a more traditional traffic ticket.
Third, there will be mandatory surcharges associated with a VTL offense that will make the total cost of this conviction higher than most.
Fourth, the JHOs in the summons parts often can be made upset at the behavior described in these reckless driving summonses, making favorable resolutions difficult or even impossible. I recently appeared on a reckless driving summons in which the JHO took the opportunity to make a speech in open court about the dangers of drag racing. Needless to say that case was not resolved on that day. When reckless driving cases are resolved, it is often with higher fines than other sorts of common summons matters.
The text of the reckless driving statute:
Reckless driving shall mean driving or using any motor vehicle, motorcycle or any other vehicle propelled by any power other than muscular power or any appliance or accessory thereof in a manner which unreasonably interferes with the free and proper use of the public highway, or unreasonably endangers users of the public highway. Reckless driving is prohibited. Every person violating this provision shall be guilty of a misdemeanor.
